Communal Spaces
With the loss (following protests at the proposed removal of the hedge to the Eastern Boundary), of the £5,500 Community Infrastructure Levy (CIL) Project and the intention to bring the unused plots 22A&B and 23 A&B back into tenanted use for residents of Upbury Grange (as per the CIL criteria), the Council has agreed that these plots, together with Plot 8, can become non cultivated “Communal Areas” available to all Allotment Tenants
Agreement to Use Communal Spaces
In recognising that Plots 22A&B, 23A&B and Plot 8A will be available for use as Communal Spaces it is necessary to grant permission (Tenants cannot go onto another plot without the permission of the plot occupier) for Allotment Tenants and their partners / families and guests to use the spaces, and the Council has produced a permission in the form of an agreement enabling this and conditioning the use as per the conditions of the Allotment Tenancy Agreement. This will be issued to all tenants in the near future.
In granting this permission it should be noted that it is likely that the 25,000 increase in the housing numbers in Dorset required by Central Government’s Housing Strategy will require additional housing within the parish over and above what is identified within the Yetminster & Ryme Intrinseca 2017-2036 Neighbourhood Plan. Any such additional housing can be expected to increase the demand for allotment space and in agreeing to the communal use of Plots 22A&B, 23A&B and Plot 8A the Council reserves the right to revoke the agreement/permission to cater for this need.
Hamcrate Allotments, Sussex Farm Way, Yetminster
Agreement /Permission To Enter Upon and Use Plots 22 A&B, 23 A&B and Plot 8A.
and To Access General Internal Communal Allotment Areas as Ratified by Yetminster & Ryme Intrinseca Parish Council on 28th May 2025 under Minute Ref: 28.05.11(e)
(Words in this Agreement have their usual meaning unless otherwise defined)
This Agreement to Use Land is a consent from the Parish Council of Yetminster & Ryme Intrinseca as owner of the land known as the Hamcrate for the registered tenants of the Hamcrate Allotments and guests or others under their control to enter upon and use the plots identified as Plot 22 A&B, Plot 23 A&B and Plot 8A and general internal communal land associated with the Hamcrate Allotments for the purpose of non-permanent and temporary ancillary applications associated with allotment cultivation and allotment use. It does not bestow the right to enter onto any part of the Hamcrate Allotments other than as specified nor the right to enter onto an individual tenant’s plot.
As such the users of the aforementioned land namely Plot 22 A&B, Plot 23 A&B and Plot 8A and general internal communal land associated with the Hamcrate Allotments will ensure that the following conditions are met and complied with when they are in occupation: –
Conditions:
1) The Allotment Tenant must at all times during the occupation observe and comply fully with all enactments, statutory instruments, local, parochial, or other byelaws, orders or regulations affecting the Hamcrate Allotment Site.
2) The Allotment Tenant must comply with the Conditions of Use attached as Schedule 1 to the Allotment Tenant’s own signed Allotment Agreement .
3) The Allotment Tenant must not cause, permit, or suffer any nuisance or annoyance to any other plot holder or neighbouring resident of the Allotment Site and must conduct themselves appropriately at all times.
4) The designated Allotment Communal Space comprising Plot 22 A&B, Plot 23 A&B and Plot 8A may not be used for any illegal or immoral purposes and the Allotment Tenant must observe all relevant legislation or codes of practice relating to activities they conduct on the Allotment Garden.
5) The Tenant shall not enter onto any other plot at any time without the express permission of the relevant plot holder.
6) Any person who accompanies the Allotment Tenant for the purpose of non-permanent and temporary ancillary applications associated with allotment cultivation and allotment use may not at any time enter onto another plot without the express permission of the relevant plot holder.
7) The Allotment Tenant is responsible for the actions of their children and others under their control entering onto Plot 22 A&B, Plot 23 A&B and Plot 8A and general internal communal land associated with the Hamcrate Allotments who are doing so with the tenant’s permission.
8) The maintenance (hedge cutting, grass cutting etc.) of Plot 22 A&B, Plot 23 A&B and Plot 8A will form part of the overall allotment maintenance programme and will be costed from the annual allotment rental income.
9) This agreement to enter upon and use land does not grant exclusive possession of Plot 22 A&B, Plot 23 A&B and Plot 8A, does not amount to an interest in land and is personal to the parties. There is no intention between the parties to create a relationship of landlord and tenant which differentiates it from other types of tenancies and the issued Allotment Tenancy Agreements.
10) The Yetminster & Ryme Intrinseca Parish Council may, at its discretion, and upon receipt of written application so to do, grant temporary permission for entry upon and use of Plot 22 A&B, Plot 23 A&B and Plot 8A for purposes other than as specified above and may make or stipulate specific requirements appertaining to that entry or use.
11) The Yetminster & Ryme Intrinseca Parish Council may, at its discretion, revoke this agreement at any time and will not be required to give a reason for so doing.
